Who these terms are between

These terms govern your use of the Fajem & Co. website and the communications we send you. If you engage us for advisory work, that engagement is governed by a separate written agreement, which takes precedence over these terms wherever the two differ.

“We” and “us” mean Fajem & Co. “You” means the person or business using this site or receiving our messages.

What we do

Fajem & Co. advises owner-operated businesses on exit readiness, strategic growth, business building, and life after a sale. Our services are provided under a written engagement agreed in advance.

What this website is, and is not

The content on this website is general information about our services. It is not legal, accounting, tax, or financial advice, and it is not a valuation. Do not act on it without advice specific to your circumstances. Nothing on this site creates an advisory relationship between us — that begins only when we have both signed an engagement.

No guarantee of outcome

Business outcomes depend on many things outside anyone's control: your market, your buyers, your team, the economy, and your own decisions. We do not guarantee that you will sell your business, achieve any particular price, reach any particular level of growth, or obtain any particular result. Any figures, ranges, or examples we discuss are illustrative.

Communications

If you contact us, we will reply.

We send commercial email only where you have asked us to or where we have an existing business relationship, and every one carries a working unsubscribe link and our mailing address.

We send text messages only to people who have agreed on a recorded telephone call to receive them, and only about a meeting that has already been arranged. Message frequency is one to four messages per booked meeting. Message and data rates may apply. Reply HELP for help or STOP to opt out; an opt-out takes effect immediately and applies to email as well.

Telephone calls with us may be recorded. We tell you at the start of the call when they are, and you may ask us not to.

Fees and payment

Fees are set out in your engagement agreement. Invoices are payable on the terms stated on the invoice. We may suspend work on overdue accounts.

Confidentiality

What you tell us about your business stays between us. We do not disclose it except where you have asked us to, where the law requires it, or to our own professional advisers under the same duty of confidence. This survives the end of our engagement.

Intellectual property

The content, materials, and frameworks on this website and in our work belong to Fajem & Co. You may use materials we prepare for you within your own business. You may not republish, resell, or distribute them.

Limitation of liability

To the extent the law allows, our total liability arising out of or connected with these terms or our services is limited to the fees you have paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits, lost opportunities, or loss of business value.

Nothing in these terms limits liability that cannot lawfully be limited.

Third-party links

Where we link to another website, we do not control it and are not responsible for its content or its privacy practices.

Privacy

Our handling of personal information is set out in our Privacy Policy.

Changes

We may update these terms. The date at the top shows when they last changed, and the version on this page at the time you use the site is the one that applies.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction.
